There is no law in Luxembourg that regulates fixations and/or sedation.

How is it regulated?

Any hospital or other establishment such as for example a nursing home has its own guidelines which specify exactly when fixation and/or sedation can be carried out. There must also be a protocol on the measurement and there must also be accurate and continuous monitoring.

When and under what conditions?

These measures should only be applied if a patient poses a danger to themselves or others or if it is medically necessary. This must also be noted in detail in the patient file. The principle of minimum restriction still applies here.

Who has the right to authorize this measure?

These measures can only be carried out on the prescription of a doctor. This must also be noted in the patient record. Nursing staff are not authorized to order such a measure.
The family must also be informed and listened to beforehand.
